BrokenTusk Technologies Private Limited ("Setu", "we", "us" or "our") provides a bill payment facility through its platform, applications, APIs, and partner interfaces (collectively, the "Platform"). These Terms and Conditions ("Terms") explain how the bill payment facility works and what you can expect when you use it.
By making a bill payment using Setu, you agree to these Terms.
1. What Setu Does
- Setu helps you pay bills issued by third-party service providers such as utilities, telecom operators, DTH providers, insurers, educational institutions, government bodies, and other billers ("Billers").
- Setu does not provide the underlying goods or services for which the bill is raised. Those services are provided by the relevant Biller.
- Billers, bill categories, and payment options may change from time to time.
2. Who Can Use Bill Payments
- You must be legally capable of entering into a contract and authorized to use the payment method you select.
- You are responsible for entering the correct bill details (such as consumer number or account ID). Setu is not responsible for payments made using incorrect details.
- You must use the bill payment facility in accordance with applicable laws and regulations.
3. How Payments Work
- Payments are processed through banks, payment aggregators, NBBL, UPI, card networks, or other regulated payment partners.
- A payment is considered successful only after confirmation is received from the payment partner or the Biller.
- Setu does not guarantee that a payment will be credited instantly by the Biller. Credit timelines depend on the Biller and payment system.
4. Fees and Taxes
- Some bill payments may include a convenience or service fee. Any applicable fee will be shown to you before you confirm the payment.
- Applicable taxes will be charged as per law.
5. Failed or Pending Payments
- Payments may fail or remain pending due to technical issues, bank delays, network problems, or Biller-side issues.
- If your account is debited but the payment fails, the amount will be refunded to your original payment method within the timelines prescribed by applicable regulations or payment partner rules.
- Setu is not responsible for delays caused by banks, payment partners, or Billers.
6. Refunds, Cancellations, and Disputes
- Once a bill payment is successful, it usually cannot be cancelled.
- Refunds (if any) are governed by the Biller's rules and applicable payment system guidelines.
- For issues related to the service provided by a Biller or the bill amount, you should contact the Biller directly. Setu may help with transaction-related support.
7. Your Authorisations
- You authorise Setu and its payment partners to debit your selected payment method for the bill amount and any applicable charges.
- You allow Setu to share transaction details with banks, Billers, payment system operators (including NBBL/NPCI), and regulators as required.
8. Offers and Cashbacks
- Promotional offers, discounts, or cashbacks (if any) are subject to additional terms.
- Setu may reverse benefits if a transaction is cancelled, refunded, found to be invalid, or violates these Terms.
9. Suspension or Restriction of Use
Setu may suspend or restrict your access to bill payments if required by law, regulation, or if we reasonably believe there is misuse, fraud, or a breach of these Terms.
10. Limitation of Liability
- Setu is not responsible for any indirect or consequential losses.
- Setu's total liability for any transaction will not exceed the fees (if any) charged by Setu for that transaction.
11. Your Responsibility to Indemnify
You agree to compensate Setu for losses or claims arising from your misuse of the Platform, violation of these Terms, or violation of applicable law.
12. Intellectual Property
All rights in the Platform and related content belong to Setu or its licensors. You may not copy or misuse them.
13. Privacy
Your personal data is handled in accordance with Setu's Privacy Policy and applicable data protection laws.
14. Changes to These Terms
Setu may update these Terms from time to time. The updated Terms will apply when you continue to use bill payments.
15. Governing Law
These Terms are governed by the laws of India. Courts in Bengaluru, Karnataka, will have exclusive jurisdiction.
16. Customer Support and Grievances
If you have questions or complaints about a bill payment, you can contact Setu through the support details available on the Platform.
17. AI-Powered Features
17.1 Use of Artificial Intelligence
Certain features of the Platform may use artificial intelligence or machine-learning models ("AI Features") to assist you, such as understanding your queries, presenting bill-related information, or providing transaction details. AI Features operate automatically based on your input and system data.
17.2 Nature and Limitations of AI Output
- AI-generated output is provided for informational and assistance purposes only.
- They may be inaccurate, incomplete, or outdated and should not be treated as definitive, authoritative, or error-free.
- You are responsible for independently reviewing and verifying all bill details, amounts, and payment confirmations before completing a transaction.
17.3 No Advice or Decision-Making
- AI Features do not provide financial, legal, or professional advice and do not make payment decisions on your behalf.
- All payment actions are explicitly initiated and confirmed by you through the Platform.
- Setu is not responsible for any action taken by you based solely on AI-generated outputs.
17.4 Data Use for AI Processing
To provide AI Features, Setu may process certain user inputs and transaction-related context through AI systems operated by Setu or third-party service providers.
Setu does not use AI Features to:
- authorise or decline payments, or
- override confirmations received from banks, payment partners, or Billers.
Personal data is handled in accordance with Setu's Privacy Policy and applicable data protection laws.
17.5 User Responsibilities and Acceptable Use
You agree not to:
- misuse, probe, reverse engineer, or attempt to extract underlying models or system prompts from AI Features;
- use AI Features for unlawful, misleading, abusive, or fraudulent purposes; or
- rely on AI-generated outputs to misrepresent information or bypass Platform safeguards.
Setu may restrict access to AI Features if misuse is detected.
17.6 Consent to AI Processing
By using AI Features on the Platform, you acknowledge and consent to the processing of your inputs through automated systems as described in these Terms.
17.7 Availability and Changes
AI Features may be modified, limited, or discontinued at any time without notice by the Platform. Setu does not guarantee the availability, performance, or accuracy of AI-generated outputs.
